Introduction
This guide provides information specific to RUSH University Medical Center's expectations and resources as they pertain to the NIH's Data Management and Sharing (DMS) policy, effective Jan 25, 2023.
The NIH's Data Management and Sharing policy is now required for all NIH-funded research. The new policy has a specific format and is expected to be two-three pages in length. There are six required elements. To see the new policy, click the link below.
Why is this important?
The NIH requires that any research funded by their organization (or subgroup of the NIH) follow guidelines set out in their Data Management and Sharing Policy. The purpose of this, as detailed in the Final NIH Policy for Data Management and Sharing, is as follows:
Purpose; Summary
The National Institutes of Health (NIH) is issuing this final NIH Policy for Data Management and Sharing (DMS Policy) to promote the management and sharing of scientific data generated from NIH-funded or conducted research. This Policy establishes the requirements of submission of Data Management and Sharing Plans (hereinafter Plans) and compliance with NIH Institute, Center, or Office (ICO)-approved Plans. It also emphasizes the importance of good data management practices and establishes the expectation for maximizing the appropriate sharing of scientific data generated from NIH-funded or conducted research, with justified limitations or exceptions. This Policy applies to research funded or conducted by NIH that results in the generation of scientific data.

Compliance and Enforcement
1. How will noncompliance with the NIH DMS Policy be handled?
NIH will monitor compliance with Plans over the course of the funding period during regular reporting intervals (e.g., at the time of annual Research Performance Progress Reports (RPPRs)). Noncompliance with Plans may result in the NIH ICO adding special Terms and Conditions of Award or terminating the award. If award recipients are not compliant with Plans at the end of the award, noncompliance may be factored into future funding decisions.
For contracts, noncompliance with the DMS Plan will be handled in accordance with the terms and conditions of the contract and applicable Federal Acquisition Regulation (FAR).
